Terms of Service

These terms cover the Mudskipper desktop and mobile apps, the gw gateway, the website at deskmint.ai, Mudskipper accounts and the Pro plan (together, "Mudskipper"). Mudskipper is operated by BlazeVPN LLC ("we", "us"). By downloading, installing or using Mudskipper, or by creating an account, you agree to these terms. If you use Mudskipper for an organization, you agree for that organization.

License

Mudskipper is proprietary software owned by BlazeVPN LLC. We grant you a personal, non-exclusive, non-transferable, revocable license to install and run the released app and gw binaries we publish, on machines you own or control, for personal or commercial work, subject to these terms.

You may not: reverse engineer, decompile or disassemble the binaries, except where applicable law allows it despite this limit; modify them or make derivative works; redistribute, sell, rent, sublicense or publicly host them; or remove or alter notices of ownership. Installing gw on your own machines, including through the app's SSH install, is not redistribution. We keep all rights not expressly granted. Third-party components keep their own licenses, listed in the third-party notices.

Accounts

The apps and the gateway work without an account. An account is needed for push notifications, machines on your account and Pro. Give accurate sign-up details, keep your password and devices secure, and tell us at support@deskmint.ai if you think your account has been compromised. You are responsible for activity under your account and for anyone you give a pairing string, which works as a credential.

Acceptable use

Do not use Mudskipper or the services we host to:

• break the law or infringe anyone's rights;
• access machines, accounts or data you are not authorized to access;
• distribute malware or attack, probe or overload our services or anyone else's;
• get around plan checks, rate limits or other access controls;
• resell or share access to the hosted relay or your account outside these terms.

We can suspend access to hosted services that are being used in breach of this section or that put the services or other users at risk.

Agents and providers

Mudskipper launches third-party coding agents. They run on your machines with your own provider accounts, credentials and filesystem and process permissions, and they can read, change and delete files and run commands. Provider approval modes and worktrees are not security sandboxes. You are responsible for which agents, tools and repositories you enable and for what agents do on your behalf. Your use of each agent and provider is governed by that provider's terms. We are not responsible for charges, usage limits or outages from agent providers, or for their handling of your data.

Pro and billing

Pro is a subscription billed in advance through Stripe, monthly or, where offered, yearly, at the price shown on the pricing page when you subscribe. It renews automatically each period until cancelled. You can cancel any time from Manage billing on your account page; Pro stays on until the end of the period you paid for and does not renew. If a payment fails, Stripe retries the card and Pro stays on while it does. Deleting your account cancels the subscription at once. Card details go to Stripe and are subject to Stripe's terms. We may change the price of Pro; a change applies from your next period after we tell you, and you can cancel before it does.

Refunds

Payments are non-refundable, including for partial or unused periods. You can cancel any time; cancelling stops future charges and Pro stays on until the end of the period you paid for. This does not limit any refund right you have under applicable law.

Changes to Mudskipper

Mudskipper is pre-1.0. Features, the wire protocol and on-disk formats may change, and we may change or discontinue parts of Mudskipper, including hosted services. Back up anything you cannot afford to lose.

No warranty

Mudskipper is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not warrant that agents will produce correct, safe or lawful output.

Limitation of liability

To the extent the law allows, BlazeVPN LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from Mudskipper or these terms, including changes, deletions or commands made by agents. Our total liability for any claim is limited to the greater of the amount you paid us for Mudskipper in the 12 months before the claim and US$50. Some jurisdictions do not allow these limits, so they may not apply to you in full.

Termination

You can stop using Mudskipper at any time and delete your account from the account page. We can suspend or end your account or license if you breach these terms. When the license ends, stop using and delete the binaries. Sections that by their nature should survive, including no warranty, limitation of liability and governing law, survive termination.

Changes to these terms

We may update these terms. The date at the top shows the latest version. For material changes we will give notice on this site or by email to account holders before they take effect. Continuing to use Mudskipper after that means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes go to the state and federal courts located in Delaware, except where the law of your country of residence requires otherwise.
